The NHPA will establish an opt-out model, meaning companies can only use your personal data with your express consent. It also requires transparency regarding the way businesses employ your personal data as well as the right to opt-out of sharing your data with a third-party, and penalties for noncompliance. Similar to the GDPR the law also prohibits discrimination against consumers who are exercising their rights to privacy. For example the company shouldn’t charge more for ensuring your privacy, or offer discounts view it now when they share your data.

Government Protection Law

Federal laws offer a variety of protection for the government. These include:

Freedom of Information Act (FOIA) 44 U.S.C. The Freedom of Information Act (FOIA) provides you with the right to access records of federal agencies. The Privacy Act of 1974 (5 U.S.C. 552) safeguards your privacy by establishing policies that govern the collection, management and disclosure of personal data by federal agencies.

The Personal Information Protection Law (Public Officers Law, Article 6-A, sections 91-99) acknowledges the public’s privacy concerns and restricts the use, collection and disclosure of personal information. It also prohibits the use of «secret files» by state agencies and prohibits the disclosure of personal information without your permission.

Whistleblowers play a crucial role in keeping our government efficient and honest. Federal law protects employees of federal contractors, subcontractors, grantees, and subgrantees from reprisals for revealing fraud, waste or abuse of federal grants or contracts.
